Criminalization of Sleeping Outside Returns in 2026 Session

From the Hoosier Housing Needs Coalition:

Legislation has been introduced in the House (HB1431) and Senate (SB285) that would create a new misdemeanor for seeping outside. This legislation also prohibits municipalities from adopting their own policies that would de-prioritize enforcement. 

This legislation does nothing to address the root causes of homelessness and does nothing to substantively support local service providers in connecting affected Hoosiers with stabilizing resources.  

We urge you to contact your Senators and tell them a new misdemeanor does not keep anyone in their home or put more beds in emergency shelters. 

This bill would hurt, not help Hoosiers facing homelessness. It would make tomorrow worse than today, and circumstances today are already far less than our most vulnerable neighbors deserve.
